Overview
Friym's mission is to enable African creators and creators worldwide to sell directly to their community, with no friction, no intermediary, and no redirection. Friym Pages (the "Page Services") are designed to give organizations, businesses, brands, and professional creators a native commercial presence within the social feed - allowing them to connect with their community, share content, and sell products and services directly on the platform.
1. Agreement
Friym is a service published by FIDEVO GROUP SAS, a company incorporated in Benin, registered with the Trade and Personal Property Credit Register under number RB/PNO/25 B 6467 dated November 20, 2025, Porto-Novo, Republic of Benin. FIDEVO GROUP SAS acts as a software service provider, and not as a payment service provider or merchant of record - see section 2.4 below for details on Friym's role in transactions.
By creating, becoming an Administrator (as defined below), or continuing to act as an Administrator of a Page as part of the Page Services, you agree to be bound by the contractual terms between Friym (FIDEVO GROUP SAS, hereinafter referred to as "Friym", "we", "our", and "us") and your Organization (as defined below).
"Organization" means the entity represented by your Page, which may be a legal entity (company, association, institution) or yourself, if you operate as an independent professional or individual creator.
By creating a Page, you represent and warrant that you are authorized to enter into these terms on behalf of the Organization.
If you do not agree to these terms, do not create a Page and do not use the Page Services.
These Terms of Service apply together with Friym's Terms of Use, Privacy Policy, and, if your Page enables its shop, the Friym Terms of Sale. Additional terms may apply to specific features as they become available, including creator subscriptions or partner integrations.
2. Obligations
2.1 Administrators
"Administrator(s)" means the member(s) of a Friym account who created the Page or have been designated as administrators of it.
You acknowledge and agree to the following:
- The Page must have at least one identified Administrator at all times.
- Each Administrator must have an active, properly identified Friym account.
- You are responsible for all actions taken on the Page by yourself and by any Administrator you designate.
2.2 Accuracy of information and updates
You agree to accurately represent your Organization's identity on the Page and to promptly update any change in name, legal status, or activity, including in the event of a merger, acquisition, restructuring, or cessation of activity.
2.3 Content and code of conduct
You agree to the following:
- You will only publish content that is truthful, accurate, professional, and respectful of the rights of third parties.
- You will only use the Page Services to promote your own Organization and its legitimate products or services.
- Your Organization conducts a lawful activity in accordance with applicable law in the countries where it operates.
- You will not publish content that is misleading, fraudulent, discriminatory, or that infringes upon the dignity of individuals or groups.
- You will ensure that all actions taken on the Page (posts, edits, deletions) comply with applicable law.
- You will not imitate, reproduce, or misappropriate the visual identity, name, or brand of another organization without authorization.
2.4 Shop activation and Friym's role in transactions
Your Page may activate a shop to sell digital products and services directly to your community. Shop activation is subject to your explicit acceptance of the Friym Terms of Sale, which govern in detail the commission, payout timelines, delivery, refunds, and dispute handling.
FIDEVO GROUP SAS acts as a software service provider and is neither a payment institution nor a merchant of record. Payment processing and fund disbursement services are provided by licensed payment service providers that partner with Friym. Friym orchestrates the order and the commission, without holding or custodying users' funds.

2.5 Data protection
The collection, use, and processing of personal data of users in connection with your Page are governed by Friym's Privacy Policy. As an Administrator, you agree to:
- Process any data relating to users in a lawful and transparent manner.
- Not collect, store, or use buyers' personal data beyond what is strictly necessary to fulfill an order.
- Comply with applicable personal data protection laws (including GDPR for European users, and applicable local laws).
3. Intellectual property
You represent that you own or have obtained the necessary rights to any content published on your Page (text, images, videos, logos, trademarks, etc.). Friym does not claim any ownership rights over the content you publish, but you grant Friym a non-exclusive, worldwide, royalty-free license to display, distribute, and promote such content as part of the platform's normal operation.
Friym reserves the right to remove any content that infringes the intellectual property rights of third parties, following a valid notice.
4. Friym's rights over Pages
You acknowledge and agree to the following:
- Friym may modify, suspend, or remove a Page at any time, including in the event of a breach of these terms, without prior notice.
- Friym may add clarifying information or legal notices to a Page when necessary to protect users or comply with the law.
- Friym may restrict access to the Page Services in the event of suspicious, fraudulent, or non-compliant activity.
- Friym has no obligation to indefinitely store content published on a Page.
- Administrators' actions may be visible to other users as part of the platform's normal operation.
5. Modification and termination
5.1 Modification of terms
Friym may modify these terms at any time. In the event of a material change, Friym will make reasonable efforts to notify Administrators through the platform or by other appropriate means, with a reasonable period before the change takes effect. Continued use of the Page Services after such notice constitutes acceptance of the modified terms.
5.2 Termination
You may terminate your agreement at any time by deactivating your Page from your account settings. Friym may terminate access to the Page Services by deactivating the Page and notifying at least one Administrator. Sections 2.4, 2.5, 3, 6, and 7 survive any termination.
6. Disclaimer of warranties
Friym provides the Page Services on an "as is" basis and without warranty of any kind, express or implied. Friym does not guarantee the continuity, uninterrupted availability, or error-free operation of the Page Services. To the fullest extent permitted by applicable law, Friym disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of liability
7.1 Exclusion of indirect damages
To the fullest extent permitted by law, Friym shall not be liable for loss of profits, loss of data, loss of business opportunity, or any indirect, incidental, or consequential damages arising from the use or inability to use the Page Services.
7.2 Limit on direct liability
Friym's total liability to you under the Page Services is limited to the amount of commissions actually received by Friym on your Page's transactions during the three (3) months preceding the event giving rise to the claim.
7.3 Exceptions
The limitations set out in sections 7.1 and 7.2 do not apply in cases of fraud, willful misconduct, or gross negligence attributable to Friym.
8. Governing law and dispute resolution
These terms are governed by the laws of Benin. Any dispute relating to their interpretation or performance shall be subject to the exclusive jurisdiction of the competent courts of Porto-Novo, Benin, except where mandatory law applicable to the user in their country of residence provides otherwise.
9. General provisions
- This agreement constitutes the entire agreement between you and Friym regarding the Page Services and supersedes any prior agreement on this subject.
- If any provision of these terms is found unenforceable, it will be modified to the extent possible to make it enforceable, without affecting the remaining provisions.
- Friym's failure to act in the event of a breach of these terms does not constitute a waiver of its rights to enforce them later.
- You may not assign your rights and obligations under these terms without Friym's prior written consent.
- In the event of any discrepancy between the French and English versions of these terms, the French version shall prevail for users residing in a French-speaking country.
